Tension as fresh litigation to disqualify Sylva fails

The Court of Appeal sitting in Abuja has thrown out a petition seeking to exempt Timipre Sylva, candidate of the All Progressive Congress from participating in the polls on Saturday.

In a unanimous decision, a three man panel held that the said petition was already statute barred, having been filed outside the approved window time.

The lead Justice, Binta Zubar, in the verdict held that the argument of Sylva doing more than 8 years as go was false since his first election was annulled by a competent court.

Justice Zubar also expelled the petition claiming that the primary elections on April 14 that produced Sylva as flag bearer of the All Progressives Congress (APC) was against the constitutional rights.

The panel while referencing substantial evidence from Independent National Electoral Commission (INEC) and APC affirmed that the elections were held within the armbits of the constitution.

A member of the APC, Hon Isikima Ogbomade Johnson, had filed a petition challenging the authenticity of the primaries that produced Sylva as flag bearer.

However, Sylva in his defense response, pointed that he being the aspirant with the highest number of votes of 52,062 won the primary elections squarely.
